MoBEE Fix commits to repairing your product according to the description provided and at the cost specified on your estimate or invoice form. If there are any changes to the initial charges, Mobee Fix will seek your oral or written consent before proceeding with the repair.
MoBEE Fix is responsible for repairing your product as detailed in the estimate or invoice form, and any changes to the charges will require your consent. If your product is under a warranty or extended service contract, you should contact the manufacturer directly, MoBEE Fix will not honor warranty repairs for products that are under a manufacturers warranty or extended contract. MoBEE Fix may also choose to subcontract with other service providers to ensure the successful repair of your product.
I hereby authorize MoBEE Fix to repair the above-mentioned device. I understand that I am responsible for payment(s) for any repairs made to accepted devices. MoBEE Fix will contact the customer to provide an estimated cost for the repair before proceeding with any work. I also understand that MoBEE Fix will not be held responsible for any data loss or damage that may occur during the repair process.
In compliance with the highest degree of legal allowance, MoBEE Fix and its associated entities shall not bear responsibility for any special, indirect, incidental, or consequential damages that may result from the execution of any repair services provided. Such damages may encompass, but are not restricted to, the following: loss of revenue, both actual and expected profits (including contract-related profits); loss of monetary usage; loss of anticipated savings; loss of business opportunities; loss of goodwill; damage to reputation; loss or corruption of data; as well as the expenses incurred during the process of recovering, programming, or restoring any software or data utilized in conjunction with your product.
MoBEE Fix does not assure that it can (i) carry out repairs or replacements on your product without posing a risk to or causing the loss of programs or data, and (ii) uphold the confidentiality of the data stored on your device. In the event that your product is damaged or misplaced while under the care of MoBEE Fix, our liability will be confined to covering the costs associated with repairing or replacing the impacted component. MoBEE Fix will not be held accountable for any loss or corruption of data, or for maintaining the privacy of your confidential, proprietary, or personal information, as well as any removable data.
Before entrusting your product to MoBEE Fix for any repair services, we recommend that you create a backup copy of all your data to prevent potential loss. Additionally, make sure to remove any sensitive, proprietary, or personal information from your device. It is also essential to detach any removable media, such as floppy disks, USB flash drives, external CD/DVD drives, CDs, or PC cards, prior to submitting your product for repair.
If your product is under a warranty or an extended service contract, you should reach out to the manufacturer or the relevant third-party vendor that manages the warranty. MoBEE Fix does not handle warranty-related repairs for products with existing manufacturer or third-party vendor warranties.
When your product is covered by a warranty or extended service contract, certain repair costs might be covered by the manufacturer or third-party vendor. However, there could be additional charges that you need to bear, which are outlined in your warranty or service contract documentation.
In such cases, you are responsible for understanding and paying these additional charges as per the terms and conditions of your product's warranty or extended service contract. This is important to know because MoBEE Fix does not provide warranty repairs for products that are still under a manufacturer or third-party vendor warranty, and any costs associated with such repairs will be your responsibility.
Resolving dispute: In the event of a dispute, you are expected to work with MoBEE Fix to find a resolution. Both parties should engage in open communication and negotiation to address and resolve the issue amicably.
No disparagement: If you are unable to resolve the disagreement with MoBEE Fix, you agree not to disparage or post negative reviews about MoBEE Fix or its associated firms on any social media platforms, such as Facebook, Google, LinkedIn, Yelp, etc.
Liquidated damages: Should you breach this term of the agreement by posting disparaging content or negative reviews, MoBEE Fix will suffer undetermined economic damages. As a result, you agree to pay MoBEE Fix $3,000 as liquidated damages, which is a pre-determined compensation amount, not a penalty. You also consent to MoBEE Fix charging this amount to your credit card on file with their firm.
Waiver of privacy rights: If you breach the agreement by posting disparaging content or negative reviews, you also waive your rights to privacy concerning any information that MoBEE Fix may need to respond to inaccuracies or falsehoods in your posting. This means that MoBEE Fix may share relevant information to address the claims in your post publicly.
In summary, if a disagreement arises between you and MoBEE Fix, both parties should work together to resolve it. If no resolution is reached, you agree not to disparage MoBEE Fix or its firms on social media. Should you breach this term, you are liable to pay $3,000 in liquidated damages and waive your privacy rights regarding any information MoBEE Fix may use to respond to your post.
